NORCROSS, Ga. January 14, 2013—“The totally unconstitutional idea that preborn children are not persons has been soundly debunked by the Alabama Supreme Court,” said GRTL President Dan Becker.

“This watershed decision should encourage Georgia lawmakers that approving a personhood constitutional amendment can withstand legal challenges,” Becker added.

Becker said the groundbreaking ruling “completely undermines the foundation of Roe v Wade which is based on the shamefully fraudulent assumption that the preborn are not persons.”

Last Friday, the Alabama court ruled that the state’s “chemical endangerment” statute for children applies to both born and preborn children.  Even though the statute does not specifically mention them, the court ruled that the “plain meaning” of the word “child” includes the preborn.

The case involved an appeal of the conviction of a woman who admitted she smoked methamphetamine three days before her baby was born at 25 weeks.  The infant died a few minutes after birth.

“This is the first time since Roe was decided in 1973 that a court has granted personhood status to the preborn,” Becker said.  “I am greatly encouraged that Georgia, which has proven to be prolife, will now grant the same protection to our innocent children.”

Last August, more than 66 percent of Republican Primary voters approved the idea of placing a personhood constitutional amendment before all voters.  Such a question can only be placed on the ballot by the State Legislature.

And in last November’s general election, 78 of the 90 totally prolife candidates endorsed by GRTL won, representing an 87 percent success rate.

“Georgians clearly value protecting the sanctity of all innocent life,” Becker said.  “GRTL is committed to ensuring that such protections are included in our constitution.”
