Georgia Prenatal Equal Protection Act

On February 13, 2025, a monumental step was taken toward ending legalized abortion in Georgia when House Bill (HB) 441 – the Georgia Prenatal Equal Protection Act – was filed.
The bill was assigned to the House Judiciary Non-Civil Committee. We have been informed that the House Judiciary Non-Civil Committee plans to conduct a hearing on HB 441 – the Georgia Prenatal Equal Protection Act (GA-PEPA) before the end of March. Please contact them and urge them to conduct a hearing immediately then vote HB 441 out of committee to the full Georgia House of Representatives for a vote.
The Georgia Prenatal Equal Protection Act would provide equal protection and equal justice to children in the womb, with no exceptions. The same laws that currently exist to protect all people from murder would extend to protect the preborn from murder.
The 14th Amendment to the US Constitution states:
“…nor shall any state deprive any person of life, liberty, or property, without due process of law nor deny any person within its jurisdiction the equal protection of the laws.” Protecting innocent life by law is a paramount duty of government.

HB-441 already has the support of the Georgians Ending Abortion coalition, a diverse coalition of legislators, citizens, pastors, community leaders, and post-abortive mothers and fathers around the state.
More than 10,000 people have signed the Georgia Personhood Amendment Petition (previously HR-413) since 2023 – which calls for a total ban on legalized abortion.

Protect Personhood
As a Christian organization, Georgia Right to Life is governed by the Word of God, which prohibits abortion. The Bible plainly states that “God created man in his own image…” (Gen 1:27) and every preborn baby is a human person from its earliest beginning (Ps 139:13-16). The Bible prohibits the taking of innocent human life in the sixth commandment “Thou shall not murder” (Exodus 20:13).
Jeremiah 1:5 demonstrates that God knows the preborn in the same way he knows a person outside the womb. “Before I formed thee in the belly I knew thee; and before thou came forth out of the womb I sanctified thee, and I ordained thee a prophet unto the nations.”
To be consistent with God’s Word, the laws which protect human beings who are born must equally protect those not yet born.
Finally, Matthew 22:30 says, “Thou shalt love thy neighbor as thyself.” The willful murder of millions of our innocent preborn neighbors is heinous in the sight of God — we are committed to seeing it end, by God’s grace and mercy.

Why does Georgia Need GA-PEPA?
Georgia needs PEPA to stop the killing of children in the womb. In 2023 alone, at least 30,856 innocent preborn babies were legally killed by abortion in Georgia. In 2022, the number was 35,401. Untold more died by self-administered chemical abortifacients. Georgia DPH statistics for 2019 through 2022 indicate that abortion is on the rise showing a total of 35,401 abortions in 2022, up from 34,989 abortions in 2021.

How is the GA-PEPA different or better than the current Georgia abortion law?
With the current abortion laws, children in the womb are being killed every day because of the loopholes and exceptions. In 2022, more preborn babies died by abortion than in 2021. “Pro-life” law, by definition, provides equal protection under the law for every preborn baby. It does not discriminate against a select class of preborn babies by identifying one class of preborn babies as legal to murder while another class is illegal to murder.
Why are people saying we should wait to pass any other bills until the Georgia Supreme Court rules on whether the current law will stand or be overturned?
This rhetoric has been used for the last 50 years. It’s never the “…right time to end abortion”. Let’s look at this question logically. There is no downside to having legislation that provides equal rights and justice for all preborn babies in Georgia.
If the court rules that the current law stands, then we have legislation in place that will close the loopholes and exceptions so that children in the womb are not being killed by legal abortion. If the court says the law is overturned, then we have legislation in place that will provide equal justice and equal rights for children in the womb.
Would the PEPA legislation cause miscarriages to be investigated, or make ectopic pregnancy surgery illegal?
HB-441 would provide that preborn babies in the womb receive the same legal protection as babies who are born. It would NOT cause miscarriages to be investigated or make ectopic pregnancy surgery illegal.
Does this legislation criminalize women?
No, laws criminalize actions not individual people. This legislation criminalizes the act of abortion and removes discriminatory provisions that allow abortion to continue.
